KRUG GETS 90 DAYS JAIL AND 2400 HOURS COMMUNITY SERVICE

On Wednesday the court room was filled to capacity and not everyone was able to be inside to witness what took place. Many people had to anxiously wait outside for the court to convene.

Judge Mize began the proceedings by reading the names of everyone who wrote him a letter. He received well over 100 letters. We then had to deal a few more legal issues followed by a short recess. Thanks to each and every person that took the time to write the judge. We do believe that he actually took the time to read them.

After the recess we started the Victim Impact Statements. The Barkey's opened with their statements followed by a wonderful video. The Baker’s then followed with their statements followed by another exceptional video. Following the videos and statements, there were many empty boxes of tissues and everyone in the court including the bailiffs and news reporters had a tear in their eye. However, noticeably Mr. Krug, his family and Mr. Krug’s lawyer showed no reaction at all, as if the videos and statements had never existed. Following the videos was another recess for lunch.

When court was back in session, Judge Mize began to sentence Mr. Krug. He will spend 90 days in jail; serve 2,400 hours of community service, and a 3 year probation. The Judge also revoked Mr. Krugs driver’s license for the entire 3 year probation time.

The Community Service was a positive change from the initial offer given to Mr. Krug. The original offer from the judge was the 90 day jail time followed by 1 year of house arrest, obviously that wouldn’t have been much of an inconvenience for him. The judge explained to us that the 2400 hours of service equals out to 8 hours a day, 5 days a week for 60 weeks, equaling a total of 14 months of service, giving Mr. Krug the maximum amount of punishment he could.

We believe that all the letters that were written did have an impact on the judge, and both the Baker and the Barkey families greatly appreciate everyone’s help and support for the past 2 years.

Let's Change the Laws

Four years in jail for killing one person and eight months for killing another! This is not enough; not enough for punishment and not enough as a deterrent. A man makes an informed, conscious decision to take drugs, then chooses a weapon and kills two people. Two young people who were doing nothing wrong, just enjoying a fall evening together.

We want to change the laws. We want tougher sentences for felony vehicular manslaughter. We want judges to make better decisions when it comes to sentencing these killers. These are huge endeavors. We have been told it will never happen, that it can't be done. But, we are dedicated. Perhaps it will make the next impaired person hesitate before getting behind the wheel, or it will make another person more careful as they use this potential weapon.

We need information and support. We know there must be many other people who are as unhappy and frustrated as we are; people who have felt there is nothing they could do. We want to hear from these people. If you have had friends or family members killed or seriously injured in a vehicular crash and have felt that justice was not obtained, please contact us. Maybe you don't want to get actively involved, then please just tell us your story.

The Memorial Ride

On behalf of the Baker and Barkey families we would like to thank everyone that took part in the Friday night ride for Carlene and Jordan.
The turn out was great! and it was quite impressive to see all those motorcycles riding down the road. We hope to have some pictures of the event posted soon.

District Attorney Jan Scully today announced that charges of Vehicular Manslaughter while Intoxicated, a violation of Penal Code Section 192 (c) (3), have been filed against a 55 year old Folsom man in connection with the October 14, 2004, crash in which two Folsom adults were killed on East Natoma Street in Folsom.

Barry Krug is charged with the deaths of Jordan Tyler Barkey, age 21, and Carlene Nicole Baker, age 20, who were killed when Krug crossed a center dividing line and struck them head-on. The victims were riding on Barkey’s motorcycle. Both victims were wearing helmets. Krug lost control of his vehicle in traffic while traveling eastbound on East Natoma Street. He slid approximately 176 feet across the road into on-coming traffic, striking the victims who were westbound on East Natoma Street.

Tests after the crash revealed Krug to be under the influence of a combination of 4 different prescription drugs; Hydrocodone, a prescription form of Vicodin; Methadone; Carisoprodal, a prescription form of Soma; and Meprobamate, a prescription form of Dolophine. Records obtained during the investigation revealed that Krug signed a notice from his doctor indicating that these drugs could adversely affect his ability to drive a motor vehicle. A toxicology expert was ultimately consulted to provide an opinion regarding the quantity and combination of drugs found in the defendant’s system relative to the impairment of his driving.

If convicted, Krug faces a maximum penalty of 4 years 8 months in State Prison.

Two Killed When Car Collides with Motorcycle

Folsom police are investigating an accident that took the lives of two young adults Thursday night. The crash occurred when a car crossed the centerline and collided with the motorcyle the victims were riding.

According to police, the accident occurred at about 8:30 p.m. when a BMW driven by a 54-year-old man began to drift off the roadway near the intersection of Briggs Ranch Road and East Natoma Blvd. The man overcorrected, crossing the double-yellow line into oncoming traffic and colliding with the motorcycle.

Killed in the crash were 20-year-old Jordan Tyler Barkey of Rancho Cordova and Carlene Baker of Cameron Park, also 20. Barkey was pronounced dead at the scene, while Baker was transported to Sutter Roseville Hospital, where she succumbed to her injuries.Both Barkey and Baker were both active in local motorcycle clubs and interested in motorcycle racing.

Police say speed appears to have been a factor in the crash, and are looking into the possibility that the BMW driver was involved in street race when the accident occurred.
